Two Years After Teacher Nicole Dufault's Arrest, Case Still Has Not Gone to Trial

Maplewood, New Jersey: Two years after a local high school teacher was arrested, the case has still not gone to trial.

Essex County Place broke the news two years ago today that Columbia High School teacher Nicole Dufault, of Caldwell, was charged with sexually assaulting three 15-year-old students on the property of the Maplewood campus in 2013 and 2014. Since then, Dufault was charged with the alleged sexual assaults of three more students both on and off campus, and is currently facing more than 40 counts. She was indicted in February of 2015.

Dufault's shared classroom, B238, was searched by investigators and was closed off to students following her arrest. A sign posted on the door declared the room to be "unusable". The classroom, located along Academy Street next to an underutilized stairwell, is now being used by other teachers.

The day following Dufault's arrest, Columbia High School Principal Elizabeth Aaron announced to students that the school would be "in the news" for a few months. Dufault was released on $500,000 bail from the Essex County Correctional Facility less than two months after charges were filed.

When she was employed, Dufault told students due to an alleged illness that she faced, doctors recommended that she move to Arizona so that she would not be impactedHer attorney, Timothy Smith, stated last year that frontal lobe syndrome "has rendered her defenseless to over-aggressive behavior, and that is exactly what she was exposed to". Dufault was reportedly diagnosed with the syndrome after undergoing brain surgery at a local hospital. 

Dufault taught students in 9th and 10th grades during the school year, and was part of the summer 'Bridge to Success' program. She would frequently discuss the alleged disease in class, and would allow students to follow her Instagram account. The account has since been deleted.

At her arraignment in April, 2015, Smith stated that Dufault would apply for pre-trial intervention, and Gina Iosim of the Essex County Prosecutor's Office said that a deal that would include a 15-year prison sentence in exchange for a guilty plea would be offered.

In the time since, Dufault's former supervisor, Janine Gregory, has left the South Orange Maplewood School District, and is now the English supervisor for the North Plainfield School District in Somerset County. Gregory told Essex County Place in 2015 that she "can't participate in any interviews".

Similar cases in Northern New Jersey have ended in far less time. A former West Orange High School teacher charged with sexual assault pleaded guilty less than a year after being charged, and a former West Morris Mendham High School teacher, who was also represented by Smith, pleaded guilty 14 months after being charged.

Attorney for Former Teacher Nicole Dufault Blames Frontal Lobe Syndrome for Alleged Crimes


Maplewood, New Jersey: Former Columbia High School Language Arts teacher Nicole Dufault, of Caldwell, continues to face dozens of charges in connection with the alleged sexual assaults in 2013 and 2014 of six students. This week, her attorney, Timothy Smith, of Caruso Smith Picini in Fairfield, said in a statement that frontal lobe syndrome "has rendered her (Dufault) defenseless to over-aggressive behavior, and that is exactly what she was exposed to". Dufault was reportedly diagnosed with the syndrome after undergoing brain surgery at a local hospital.

When she was still teaching, Dufault told her students that she only felt pain as a result of her illness during rainfall, and that doctors recommended that she move to Arizona. Dufault also told students in the beginning of the 2013-2014 school year that she planned to file a lawsuit against the hospital where she underwent brain surgery.

"We continue to prepare for trial so our juvenile victims may find the justice they are seeking", said Gina Iosim of the Essex County Prosecutor's Office in a statement responding to Smith's comments.

All of the alleged victims were under 18 at the time of the incidents.

Dufault was released from the Essex County Correctional Facility in Newark in late October, 2014 on $500,000 bail.

Columbia HS Teacher Nicole Dufault to be Arraigned on April 6


Newark, New Jersey - Nicole Dufault, a 35 year old Columbia High School language arts teacher and Caldwell resident, will be arraigned on April 6. Dufault was indicted in February on 40 counts of aggravated sexual assault and endangering the welfare of a child, after allegedly sexually assaulting six of her students in 2013 and 2014 at the Maplewood school. The students involved were between 14 and 15 years old at the time of Dufault's alleged crimes.

At Superior Court in Downtown Newark this morning, Dufault's attorney, Timothy Smith of Fairfield based Caruso Smith Picini said that she would apply for pre-trial intervention. 

Gina Iosim of the Essex County Prosecutor's Office said that a plea deal is being offered to Dufault. In exchange for a guilty plea, Dufault would face 15 years in the New Jersey State Prison system, with no chance of parole until 85% of her term is served. She would also be subject to parole supervision for life and would have to register as a sex offender.

Following her court appearance, Smith said that he does not believe that Dufault will accept the plea agreement. 

"We believe in her innocence", said Smith after being asked why Dufault is pleading not guilty, adding that he felt that his client is the victim.

Janine Gregory, the South Orange Maplewood School District English Language Arts supervisor, told Essex County Place that she is "unable to comment because there's an active investigation going on", and "can't participate in any interviews". Gregory was Dufault's supervisor at Columbia High School.

The alleged sexual assaults took place in Dufault's vehicle and on CHS property. Dufault's shared classroom, B238, was searched by investigators and was closed off to students following her arrest. A sign posted on the door declared the room to be "unusable". The classroom is now being used by other teachers.



Some of the alleged incidents took place during the summers of 2013 and 2014, when Dufault was an English teacher for the Bridge to Success summer program at the high school. According to the South Orange Maplewood School District website, "Bridge to Success is a four-year program that is designed to provide additional support for students who are at-risk...The summer program provides participants with academic and study skills instruction". According to school district board of education meeting documents, Dufault was an instructor for the program in 2011 and 2012 as well, and was paid $50 per hour.

In an interview with Essex County Place in November, Columbia High School principal Elizabeth Aaron criticized media coverage of Dufault's arrest and an unrelated arrest of a student on charges involving possession of brass knuckles.

UPDATED: CHS Teacher Nicole Dufault Indicted for Allegedly Sexually Assaulting Six Students


Original Post from 2/17: The Essex County Prosecutor's Office has announced that Columbia High School language arts teacher Nicole Dufault has been indicted on dozens of charges regarding alleged sexual assaults of six students. Dufault, a 35 year old Caldwell resident, was arrested in September on charges of sexually assaulting three students at the Maplewood school. Two days later, the Essex County Prosecutor's Office announced that two additional alleged victims had come forward. Today, Acting Prosecutor Carolyn A. Murray announced that a sixth alleged victim was identified.

According to a press release, "the indictment accuses Dufault of engaging in sexual activity with all six boys on multiple occasions between 2013 and 2014". 

The alleged victims were 14 and 15 years old at the time of the incidents.

Dufault was indicted on 40 counts of aggravated sexual assault and endangering the welfare of a child. The alleged sexual assaults took place on Columbia High School grounds and in Dufault's vehicle. Dufault's classroom, B238, was closed off in the days after her arrest, and several unmarked police cars were present at the school on the morning after her arrest. At the time of her arrest, Dufault had taught at Columbia for nine years.

A video allegedly shows Dufault having sex with a student in her car. Several Columbia High School students reportedly viewed the video in the days surrounding Dufault's arrest, causing one staff member to warn her class that sharing the video of the alleged incident could constitute sending child pornography.

Dufault was held in the Essex County Correctional Facility in Newark for over a month before posting $500,000 bail. She entered a plea of 'not guilty' in September, and is now scheduled to appear in Superior Court in Newark on March 6.

Dufault is considered innocent until proven guilty. She faces decades in state prison if convicted on all counts.

Update 2/18: In an email to Essex County Place, Dufault's attorney, Timothy Smith, said "I feel extremely confident in stating, and firmly believe, that there is only one victim, not six, as averred in the indictment, and that victim is Nicole Dufault". Officials with the South Orange Maplewood School District and the South Orange Maplewood Education Association union did not respond to requests for comment.

Updated: Columbia HS Principal Criticizes Media Coverage of Alleged Criminal Activities


The principal of Columbia High School criticized the media coverage of recent alleged criminal activities at the Maplewood school. In an interview today with Essex County Place, Elizabeth Aaron said that reporters "can be distracting and disruptive to students". Aaron added that she was "not really surprised" by media attention because she feels that news organizations cover "stuff they think will get the most attention".


A 17 year old student was arrested on Monday for allegedly bringing brass knuckles inside the school. CHS was on 'Code Red' lockdown for nearly two hours that day after a staff member reportedly called the Maplewood Police Department claiming that a weapon was present in the school. An 18 year old former student was arrested on Tuesday for allegedly trespassing on school property.


In September, a Language Arts teacher at the school was arrested for allegedly having sex with five of her students. Nicole Dufault, of Caldwell, was employed by the South Orange Maplewood School District for nine years. She was released from the Essex County Correctional Facility in October after her $500,000 bail was posted and is awaiting trial.


Regarding Monday's lockdown, Aaron said that she was "very impressed with the students and staff". She felt, however, that parents who arrived outside of the high school while the lockdown was taking place "made it difficult". 


"I understand the parental desire", she noted, but cautioned that "in an emergency, it can be a hamper instead of a help".

When asked about her opinion on whether metal detectors should be installed at CHS, Aaron responded that she is "100% opposed" to the idea.

"I believe in creating and sustaining a school culture that is open, supportive, nurturing and challenging for students", said Aaron. "I don’t think the presence of metal detectors supports that culture".

Overall, Aaron said that the lockdown "helped us to further understand how to manage emergencies".

CHS Teacher Nicole Dufault Released on Bail


Columbia High School Language Arts teacher Nicole Dufault, who was charged in September with multiple counts of sexual assault and endangering the welfare of a child, has posted bail. 


NJ.com reports that Dufault was released from the Essex County Correctional Center in Newark on October 19. She was arrested on September 17.

Dufault, a 35 year old Caldwell resident, allegedly had sex with five students multiple times on school property and in her car during the 2013-14 school year and during the 2014 summer school. She pleaded not guilty. 


Her attorney, Timothy Smith, told Essex County Place that Dufault is "greatly relieved, particularly with regard to seeing her family", adding that she is "anxious to begin mounting her defense".


In an email to Essex County Place, Katherine Carter, the public information officer for the Essex County Prosecutor's Office, said that Dufault "cannot have contact with the victims or the school".


Dufault remained on the list of CHS Language Arts faculty as of Wednesday.

Attorney Says Dufault is "Devastated" by Allegations, Bail Reduction Denied

-Columbia High School teacher Nicole Dufault appeared in court on Friday with her attorney to request a bail reduction. The Essex County Prosecutor's Office alleges that Dufault had sex with five male students. Her request was denied. According to NJ.com, the assistant prosecutor told the judge that there were two complaints made against Dufault during the 2013-14 school year. The assistant prosecutor also told the judge that there is a video of Dufault allegedly having sex with one of the victims. PlaceNJ.com reported that students at Columbia High School allegedly viewed the video in school the day her arrest was announced.


-South Orange Maplewood School District Acting Superintendent James Memoli and Columbia High School Principal Elizabeth Aaron issued the below letter to community members on Sunday evening regarding the arrest of CHS teacher Nicole Dufault on sexual assault charges. 


-"She has a stellar reputation as a teacher", said Timothy Smith, Dufault's attorney, in an email to Essex County Place, adding that "she is devastated by these allegations".

A sign was posted on Monday, September 29, a sign posted outside of Dufault's classroom, B238, telling students in each of Dufault's classes to report to other classrooms in the building.


Hannah Edelman, the Columbia High School representative to the South Orange Maplewood Education Association union, declined requests for comment.

The letter is as follows:

"Dear Members of the SOMSD Community: 


Our primary concern continues to be the health, safety and well-being of all of our students, staff, and families. As a result of the teacher arrest last week at Columbia High School, we are informing you of what we are doing in response, and offering you some resources. 


Rumors will always occur, and we will not be able to comment on the allegations, investigations, or any possible evidence.

-We are fully cooperating with the prosecutor’s office. 
-We are providing ongoing access to school and outside supports – including the CHS administrative team, guidance counselors, student assistance counselors, school social workers, teachers, and our employee assistance program, CONCERN.

Columbia Teacher Nicole Dufault Pleads Not Guilty to Aggravated Sexual Assault of Minors


First Reported on PlaceNJ.com: The Columbia High School teacher charged with multiple counts of aggravated sexual assault and endangering the welfare of a child pleaded not guilty to all charges. 


According to the Essex County Prosecutor's Office, 35 year old Caldwell resident Nicole Dufault allegedly had sex with at least five students in her car and on CHS property in Maplewood. Dufault was initially charged with having sex with three students. The incidents allegedly took place during the 2013-14 school year and during the 2014 summer school program.


Dufault, a mother of two young children, was arrested at night on Wednesday, September 17 at her Caldwell condominium. Dufault is recently divorced, and her ex-husband was arrested in June on charges of burglary and theft. Her children have been removed from her custody.




Multiple news outlets were present near the high school on Friday, September 19, including reporters from WCBS, WNBC, WPIX, WXTV, and WNJU. Reporters for the stations interviewed students before and after school. Principal Elizabeth Aaron asked students on Thursday, September 18 not to speak to the media, and informed students that reporters were prohibited from school grounds. 




In addition, the Maplewood Police Department posted temporary 'No Parking' signs in the neighborhood surrounding the Parker Avenue school on Friday morning.


Aaron, Assistant Principal Michael Healy, and dean Craig Rynar were present outside of CHS before and after school on Friday, September 19. Several Maplewood Police officers were present at the corner of Kensington Terrace and Parker Avenue. A WPIX news van was parked at that location and was surrounded by students. A police officer told the driver to move to another location.




No announcement was made to students during the school day regarding the alleged incident, though Aaron said it was a "gorgeous Friday morning" during the morning announcements. A letter sent yesterday by the South Orange Maplewood School District to parents said that staff "are supporting students and staff impacted by events", though no further announcement was made in the school on Friday regarding this.


In addition, some students claim that there is a video which reportedly shows Dufault having sex with a student. This video may have been viewed by several students. One staff member warned her class that sharing the video of the alleged incident could constitute sending child pornography.


A sign outside of Dufault's classroom, B238, reads "Room Unusable". The sign was posted on Thursday morning. Dufault taught at Columbia High School for nine years, and was previously known as Nicole Bradley. Her name remained on the list of Columbia High School Language Arts faculty as of this report.


According to the Personnel Fiscal Resolutions from the June 16 Board of Education meeting, Dufault was to be paid $50 per hour for being an English teacher for the Bridge to Success summer program between July 7 and July 31. According to the SOMSD website, "Bridge to Success is a four-year program that is designed to provide additional support for students who are at-risk...The summer program provides participants with academic and study skills instruction".




Dufault is being held in the Essex County Correctional Center in Newark in lieu of $500,000 bail. Her attorney is Timothy Smith of the Fairfield based Caruso Smith Picini law firm. She is presumed innocent unless found guilty.

Cimino announced today that a teacher at Columbia High School in Maplewood has been charged with sexually assaulting two more male students. Late Tuesday Nicole Dufault, 35, of Caldwell was arrested and charged with sexually assaulting three students. With the charges authorized today, the number of victims rises to five. She is accused of multiple counts of first degree aggravated sexual assault and multiple counts of second degree endangering the welfare of a child. All five of the victims are 15-year-old boys who were students at Columbia High School. Today Dufault made her first court appearance. She entered a not guilty plea to the charges involving the original three victims. All of the incidents occurred during the regular school year and also during summer school in 2013 and 2014. Dufault is currently being held at the Essex County Correctional Facility in Newark on $500,000 bail. She has been ordered to have no contact with any of the victims. Dufault has two minor children who have been removed from her custody. Columbia High School Teacher Charged with Multiple Counts of Aggravated Sexual Assault and Endangering the Welfare of a Child


First Reported on PlaceNJ.com: A language arts teacher at Columbia High School in Maplewood has been charged with multiple counts of aggravated sexual assault of a 13-16 year old and endangering the welfare of a child.

Kathy Carter, the spokesperson for the Essex County Prosecutor's Office, confirmed to PlaceNJ.com that 35 year old Nicole Dufault, of Caldwell, was arrested. Dufault allegedly had sex with at least three 15 year old students during the 2013-14 school year and 2014 summer school in her vehicle and on CHS property. Dufault is a tenured 9th and 10th grade English teacher.


Several unmarked police cars were parked outside of the Parker Avenue school Thursday morning.




CHS Principal Elizabeth Aaron made an announcement to students at 9:15am on Thursday saying that the school would be "in the news" for the next few months. Aaron added that news media are prohibited on school grounds, and asked that students not speak to media. Several New York news stations reported live from the school at 11pm on Thursday 


A sign outside of Dufault's classroom read 'Room Unusable', and told Dufault's students to report to another location.


A marked Maplewood Police Department cruiser was stationed outside of Dufault's condominium on Espy Road in Caldwell as of 6:00pm on Thursday. Dufault has two young children, and divorced recently.




According to Captain Michael Marucci of the Maplewood Police Department, the "investigation was supervised by the Essex County Prosecutor's Office".


In addition, it is rumored that CHS students have a video of Dufault performing a sex act on one of the victims, and that some students viewed the video during the school day on Thursday. This information is unconfirmed


Dufault is being held at the Essex County Correctional Facility in Newark on $500,000 bail, and is prohibited from contacting her alleged victims. She is considered innocent until proven guilty.

Several unmarked police cars are currently parked outside of Columbia High School in Maplewood. A language arts teacher at the Parker Avenue school is rumored to have been arrested, however this cannot be confirmed.


Principal Elizabeth Aaron told students at 9:15am today that the school will be "in the news" for the next few months, and asked students not to speak to media. She also told students that members of the media are prohibited on school grounds.


A sign posted outside of the teacher's classroom, B238, reads "Room Unusable".
